Enjoy all. If you must drink, don't drive. If you do drink and drive and you get caught answer no questions other than the basics. Don't answer any questions related to drinking and refuse any breath tests. You can refuse to answer any questions legally. You can print out a small card that you hand the officer letting him know that you do not wish to answer any further questions without counsel. He will be recording your conversation while at your vehicle. If you are driving intoxicated they are going to take your license away for 6 months no matter what, administrative revocation. Don't give them any more evidence than they will get from the video camera. Don't step out of the vehicle unless you absolutely must and only when the officer tells you that you are under arrest. When they book you refuse questions until you have counsel. They will be video taping your every move so be steady and courteous. Do your best to stand up straight and do not sway back and forth. Chances are you will be required to stand in a square taped to the floor. They use this box along with a video camera to record your inability to stand up properly without swaying.

BTW, I have done a lot of research and talked to numerous attorneys concerning these issues. Police officers will be doing every thing they can to show intoxication. They will ask silly questions and try to get you to do weird things like recite the alphabet backwards to throw you off. Simply refusing to answer any questions without counsel is the sure-fire way to protect your interest. Road-side sobriety tests are designed to make you fail. Don't take them. Most sober people at 2:00am will not pass a road-side test. The flash of strobes, cars passing by, uneven roadside surfaces and noise will complicate matters.

Everyone have fun and may you not have to use this advice! Happy 2005 to all!!
