    Need y'alls opinions on something. job related...

    I worked for Ryder Truck Rentals and i was a mechanic inside the shop. Well, monday evening i was working on a truck from the oil fields putting new tires on a trailor. Well, with my safety glasses on i start tightening the lugs down and dirt is flying everywhere and i feel it hittin my face. Well, i wake up the next morning to go to school and my eye is burning like something was scratching it. I go throughout the day with it and i talk to my mom about going to the doctor to get it checked and I call my boss and told her i got something in my eye last night and i was going to go get it checked out. I go to work bc my boss said she was gonna take me to the doctor to have it looked at, well before i got to work i messed with my eye and got the dirt out of it, so i told my boss i didnt need to go anymore and i didnt want to file a injury report, but she said since i said something about it that i had to. Well, my boss had filed everything out and all i did was give her my SSC# and address to my home for the injury report and never signed it. Well today at the end of my shift she calls me into her office and says since i reported a injury the day after it happened that it was a violation of Ryder policy and that i was fired. So now, being that i never went to the doctor or signed a report of injury, should i pursue a law suit against them or fight for my job back? or has anyone dealt with this issue before?

    Man that sucks dont know what to say but i hope it all works out.

    Hmm, definately something to go back and try to hash out with your boss over a cup of coffee. I'd ask her to see this policy in writing first off. Pay close attention to the wording in the document. Some places define a "day" as a 24hr period. As far as going to the doctor, that's up to you. everyone has the right to refuse medical treatment unless they are a danger to themselves or others. You also have no legal obligation to sign any paperwork concerning the "incident". All your boss might have to do legally is document the accident in writing so you don't try to sue them at a later date. I'd just try to talk it out and if that doesn't work I'd consult with a lawyer for a wrongful termination law suit.

    damn dude that sucks, i pulled a groin muscle at work on monday and all my boss did was give some pain meds. you might want to call your local department of labor and see what they say.

    i read the ryder handbook, and it does say that all injuried must be reported to your supervisor imediately, but dont have a manager on duty at night. but i didnt want to report the injury just told her i got something in my eye and i think it was from that truck.

    so on the flip side of this, could i argue what injury? i wasn't injuried, didnt go to the doctor and have no report of injury?

    Wow that sounds retarded. Sounds like your boss was not fully aware of what to do in the first place--because if she did, then she would have told you everything up front.
    I know everybody defines the word "injured" in different ways. I believe that there is an "injury" and there is being "hurt." Being hurt is like having a paper cut on your finger. And being injured renders you unable to do normal day-to-day activities.
    That is stupid--all you did was say you got dirt in your eye...and she said you were injured? I think that is total BS. I would request for a sit-down and have her explain all of this to you. Tell her you were NOT injured. You just got dirt in your eye...it wasn't like you cut yourself bad or had a heavy piece of equipment fall on you and break a bone.
    Tell her you were not injured, had no supervisor on duty at the time of your shift, and that you didn't sign a form.

    I sort of agree. There is no signature required from you but they must fill out a report that states that an injury took place. That is how a claim is set up so you can go to the doctor. As far as a law suit for wrongful termination, it depends on what type of employer they are. If they are an at will employer, then technically they can fire you without giving a reason.

    Definitely worth talking to the HR department.
