Police report should show that he is at fault. That will settle that.

well guys i figured id provide an update, it has now been a month and a half since my accident, State farm(his insurance) will not accept liability for the accident, they stated the police report is inconclusive even though every single person who has read it cannot understand HOW they gathered that result. So basically the claim goes into arbitration and i have to sit around and wait until may for a response from them, at which time they will get an outside party to decide the fault, which also leaves me with a totalled 2 place sled trailer and a damaged sled that they may not pay for even if he was at fault as they were not insured.... in the mean time i am still without my truck as the body shop is pretty much redoing the whole thing, i also had them color match the handles, mirror caps, front bumper cross bar, also bought a set of stock 20" yukon wheels/tires too. very excited to get it back hopefully this week. ill post pics when i do.

Arbitration sucks...basicly your insurance and his insurance will come to a mutual agreement of how to screw you over.

yeah pretty inconvenient, ill just be grateful i was able to borrow a vehicle to drive for the last month and a half, renting would NOT have been cheap. i agree, i only had liability on the RST last summer, best believe it will be fully insured this year, id be totally screwed right now if all i had was liability on the 07... ive backed the RST out of the garage and took a quick drive about a mile thats it. ill wait until the sand is off the roads. plus i gotta rebuild the 60e
